What Hospitals Are Required to Publish
Under the CMS Hospital Price Transparency Rule, every hospital must publish:
- A machine-readable file with all items and services, including gross charges, discounted cash prices, and payer-specific negotiated rates
- A consumer-friendly display of shoppable services (at least 300 common services)
- Standard charges must include: description, billing code, gross charge, discounted cash price, payer-specific negotiated charges, and de-identified minimum/maximum negotiated charges
How Advocates Can Use This Data
The published data enables several powerful advocacy strategies:
- Pre-care price shopping — Compare cash prices at nearby hospitals before a client schedules a procedure. The cheapest option is often 50–80% less than the most expensive.
- Bill verification — Compare a client's bill against the hospital's own published prices. If the bill exceeds the published price, you have strong grounds for a dispute.
- Negotiation leverage — Show a hospital that competitors charge significantly less for the same procedure. This is the most effective negotiation tactic available.
- Financial assistance eligibility — If a client qualifies for financial assistance, use published prices to ensure they're not charged more than what insured patients pay.
- Insurance appeals — Use published rates to demonstrate that charges are out of line with market rates in appeal letters.
